Probate refers to the process by which an individual’s estate is distributed. When an individual dies he or she is generally referred to as the decedent. The probate process involves identifying the assets of the decedent’s estate, identifying and paying the debts of the decedent’s estate, and distributing the remaining assets to the beneficiaries under the will. If there is no will, probate can also involve identifying and distributing assets to heirs.
